Vision:

The vision of the Ministry of Justice is ‘‘To lay and build a strong foundation for a united, peaceful and prosperous South Sudan based on Justice, equality, respect for human rights and supremacy of the rule of Law.’’

Mission:

The mission of the Ministry of Justice is, inter alia, to:

  • Promote democratic principles and political pluralism guided by the principles of decentralization and devolution of power
  • Ensure that rights enshrined in the CPA, the Interim National Constitution, the Interim Constitution of South Sudan and Interim State Constitutions, International Conventions, Treaties and Protocols to which the Government of the Republic of Sudan is a signatory, are respected, protected and promoted.
  • Ensure supremacy of the rule of law and that law and order is maintained, respected and promoted
  • Render legal services to the people and all levels of Government in the Republic of South Sudan
  • Create conducive atmosphere for socio-economic development in accordance with the vision, mission and programs of the Government of the Republic of South Sudan.

Functions:

The Ministry of Justice performs the following functions and duties:

  • To achieve the vision and mission, the Ministry of Justice (MOJ) performs, inter alia, the following functions and duties:-
  • Represent all levels of Government in South Sudan in prosecution, litigation and adjudication.
  • Conduct all the pre-trial proceedings in South Sudan.
  • Protect public and private property and rights.
  • Draft legislations for all levels of Government in the Republic of South Sudan.
  • Incorporation businesses and register Non-Governmental Organizations, Associations and Societies.
  • Provide legal opinion and advice to all levels of Government in the Repbilc of South Sudan.
  • Initiate and or conduct capacity building programs.
  • Conduct researches on customary law and any other area of concern.
  • Establish an Institute for Legal Studies.
  • Establish a Customary law Development Centre.
  • Print, publish, gazette, distribute and disseminate all Government of South Sudan and State laws.
  • Conduct research and initiate legal reviews and reforms. Without prejudice to the provisions of (1) above, the functions and duties of MOJ are as prescribed in ''the Ministry of Justice Organization Act, 2008.''


Structure:

Directorate of public prosecution: 


  • Rendering legal advice to the Government of the Repblic of South Sudan, State Governments and institutions in all matters relating to criminal law and criminal procedures and any other relevant penal laws.
  • Supervising investigation and prosecuting criminal cases.
  • Supervising all public attorneys at the Government of South Sudan level.
  • Preparing data and reporting on the rate of crime and submit a report thereon to the Undersecretary.
  • Appearing before Criminal Courts in South Sudan as the prosecuting authority on behalf of the Government of South Sudan and the States.
  • Performing any other functions or duties that may be assigned to it or which are reasonable related to the forgoing activities.

Directorate of Civil Litigation:

  • Rendering legal opinion to the Government of South Sudan and State Governments in all matters of civil nature.
  • Representing Government in civil litigation.
  • Arbitrating and settling civil disputes among Government institutions as well as between them and others
  • Rendering legal opinion and undertaking litigation on constitutional issues.
  • Receiving reports on civil claims from legal counsels in the States, public corporations and companies.
  • Receiving reports on civil suits against the Government.
  • Submitting memoranda to the Undersecretary or the Minister on matters requiring interventions thereby.
  • Performing any other functions and duties which may be assigned to it or reasonably incidental to the forgoing functions.

Directorate of Contracts, Human Rights conventions, Legal Aid and Treaties:

  • Providing legal opinion to the Government on contracts and negotiations leading to conclusion thereof.
  • Reviewing and recommending approval or otherwise of agreements or contracts to which a Government institution is a party.
  • Overseeing implementation of conventions, treaties and human rights and rights and freedoms enshrined in the National and South Sudan Constitution.
  • Providing legal aid to those in need
  • Providing legal opinion to the Government of the Republic of South Sudan and States Governments on violations of human rights.
  • Educating citizens on their constitutional rights through workshops, seminars and the media.
  • Identifying and studying conventions and treaties on matters affecting South Sudan and making recommendations accordingly.
  • Providing legal opinion to the Government of the Republic of South Sudan on national and State matters directly or indirectly affecting South Sudan and the States.
  • Drafting treaties, conventions and contracts to which South Sudan or a State is a party.
  • Performing any other functions and duties which may be assigned to it or reasonably related to the forgoing functions.

Directorate of Legislation, Gazette, Publication and Printing:

  • Drafting legislation including subsidiary legislation requested by the Government of the Republic of South Sudan, State Legislatures and executive branches.
  • Overseeing the progress of legislation and provision of legal opinion thereon.
  • Printing and publishing the South Sudan gazette and any other necessary government publications.
  • Translating legislation and any other legal documents from English to any other languages as may be necessary.
  • Publishing laws.
  • Reviewing, refining and improving legislative drafting process.
  • Conducting research and proposing legal reforms.
  • Performing any other functions and duties which may be assigned to it or reasonably related to the forgoing functions.

Directorate of Registration of Businesses, Associations and NGOs:

  • Registering companies, businesses, associations and NGOs.
  • Overseeing operation of businesses, associations and NGOs in accordance with the law.
  • Registering patents, inventions, industrial designs and intellectual property rights.
  • Performing any other functions and duties which may be assigned to it or reasonably related to the forgoing functions.

Directorate of Training and Research:

  • Drawing comprehensive training programme for legal counsels and support staff.
  • Conducting research on laws and legislation with the objective of improving and incorporating positive customs and traditions thereinto.
  • Establishing a customary law centre with the aim of conducting a research on customary law, recording, harmonizing and codification thereof.
  • Establishing a paralegal training centre with the ultimate goal of transforming it into an institute for legal studies or law development centre.
  • Performing any other functions and duties which may be assigned to it or reasonably related to the forgoing functions

Directorate of Administration and Finance:

  • Preparing budget proposals in consultation with other Directorates.
  • Keeping records of positions in conformity with the nominal roll of the Ministry.
  • Implementing the approved budget and advising on its expenditure.
  • Rendering technical advice on matters relating to terms of service, employment and dismissal of the employees of the Ministry.
  • Performing any other functions and duties which may be assigned to it or reasonably related to the forgoing functions

Projects and Programs being pursued:

  • Establishment of Institute for Legal studies; ( ongoing)
  • Customary law centre (ongoing);
  • Assessment Study in ten (10) States to identify training needs for both legal counsels and support staff

Publications and Documents:

The ministry prints and publishes all the laws of the Government of South Sudan and the Gazette and any other necessary governmental publications which can be downloaded from the Laws and Downloads page of its web site.
